God Bud CBD results from the identification of a special pink pistil pheno-type of God Bud. Together with one of the leading medical marijuana research organisations in Canada BC Bud Depot used pollen from a 7% CBD Harlequin BX4 male plant. The end product was spectacular.

Is It Legal to Mail CBD Oil? [Here’s What the Laws Say]

One of the main reasons we started WayofLeaf was to ensure people had access to up to date, accurate information about the globe’s hemp and cannabis markets. It is a challenging endeavor! The laws surrounding marijuana and industrial hemp in the U.S. alone seem to change with astounding regularity, and little of the legislation is particularly evident.

The fact that marijuana is federally illegal in the United States is one of the few things we can all agree on! It is legal for recreational use in 11 states and D.C., and there are medical marijuana programs in 22 other states at the time of writing. For the time being, at least, the government has shown no inclination to interfere in state’s rights regarding weed. The removal of Jeff Sessions as Attorney General helped alleviate a great deal of concern.

While marijuana and THC laws seem fairly clear (for now), confusion riddles the CBD industry over the legality of the substance. Several websites erroneously claim that CBD is entirely legal in all 50 states. The truth is less rosy for the industry, although there is basically no implementation of these laws!

When it comes to transporting hemp oil across state lines, especially in mail form, an increasing number of prospective consumers are nervous. “Will I get caught?” “What are the punishments for using CBD oils in a state where it is apparently illegal?” Such concerns prevent people from trying cannabidiol. Let’s try to set the record straight in this article.

CBD Laws – Noise & Confusion

Technically, CBD is not legal in all 50 states. If you go to Nebraska, South Dakota, or Idaho, the law suggests that the non-intoxicating compound in weed and hemp is illegal. In states such as Georgia, CBD oil must have 0.0% THC – less than the Federal guideline of 0.3%.

As such, one could say it is illegal to mail or use CBD in one of these states. However, it seems as if federal law supersedes the obscure rules of individual states, in this instance. Yes, you could end up in jail for using cannabidiol, but enforcement of the law is practically non-existent.

In South Dakota, Governor Kristi Noem says the compound must remain illegal in spite of federal law. The state’s Attorney General then released a statement in March 2019 that said hemp and CBD are unlawful. Nebraska classifies the compound as marijuana. Even so, the state has a number of CBD stores in operation.

In May 2019, a security officer at Disney World Orlando found a small bottle of CBD in Hester Burkhalter’s purse. He alerted the Orange County Sheriff’s Office. Deputies arrested Burkhalter, and she spent 12 hours in prison. Fortunately, prosecutors dropped the charges. There are a few other arrests for CBD-related ‘crimes’:

  • North Carolina police took a 16-year old girl to jail for having medicinal CBD in her backpack.
  • Louisiana police arrested the owner of a Lafayette CBD store for drug trafficking.
  • Nebraska cops arrested a mother and son team after they opened a CBD store in Scottsbluff.
  • The Ohio authorities charged Robert Faulkner with a felony for possession of half an ounce of CBD oil.

Should I Be Worried About Mailing CBD?

In theory, there is cause for concern. While CBD is as legal as soda in most places, there is a tiny percentage of areas where the substance is treated as an illegal one. However, an incredibly small number of cases make it to court. As with the fiasco in Orlando, those on the receiving end usually escape with no punishment. Authorities in states such as Nebraska talk a good game, but in reality, there are CBD stores all over the place!

Therefore, when companies claim that CBD is “legal in all 50 states,” they do so because of the lack of follow-through when it comes to cannabidiol arrests. Proponents of transporting CBD across state lines have more than one leg to stand on. The 2014 U.S. Farm Bill legalized the cultivation and commercial sale of hemp and hemp extract (including CBD oil). At that time, however, you had to grow it as part of a government pilot program for academic or research purposes.

Even at that point, there were hundreds of companies selling CBD who were not operating as part of such a program. They shipped their products nationwide to all 50 states with practically no consequences.

Effects of the 2018 Farm Bill

The Farm Bill 2018 went much further. It legalized the cultivation of hemp and declassified it as a Schedule I controlled substance. It defined ‘hemp’ as the Cannabis sativa L. plant and any part of the plant with a THC concentration of no more than 0.3%. Interestingly, the FDA confirmed that it is illegal to add CBD to food products or dietary supplements. This is because cannabidiol is an active ingredient in an FDA-approved drug. As such, it is not allowed a nutritional supplement or food supply designation.

The FDA also stated that any product marketed with a therapeutic claim must have the Administration’s approval before its introduction into interstate commerce. If we read between the lines, it suggests that mailing CBD oil is perfectly legal, as long as you don’t make any claims about its ability to heal. In other words, companies that sell CBD oil across the United States are shielded from legal issues if they stick to the facts and continue to educate prospective customers.

What About the DEA?

Even before the 2018 Farm Bill became law, the DEA admitted that it wasn’t trying to crack down on CBD sales. Back in July 2018, a spokesperson for the agency, Rusty Payne, attempted to clarify its stance. Payne said that “hemp was a made-up word,” and products coming from the plant, including CBD, were illegal. Of course, the recent Farm Bill legislation made this a moot point.

What was more interesting was the DEA’s general attitude. Payne said that the nation was in the middle of an opioid epidemic and that the agency had “bigger fish to fry.” More tellingly, he said the following:

“I think people think [CBD] is high on [the DEA’s] priority list right now. It is not.”

Even at that stage, the DEA realized that CBD was not killing people. Since the Farm Bill became law, cannabidiol is even lower down on the DEA’s list. The fact is: Hundreds of CBD companies sell the compound and transport it across state lines every single day. Aside from the occasional anomaly, you don’t hear stories of online stores, in particular, closing down due to law enforcement interference.

The USPS Speaks Out About Mailing CBD

The United States Postal Service (USPS) tried to clear up some of the confusion in March 2019. It confirmed that hemp products are legal to mail under certain circumstances because the plant isn’t a federally controlled substance. On its Postal Bulletin, the USPS said it had received many inquiries from companies and individuals about mailing CBD.

The new USPS policy states that you can mail hemp and hemp-based products like CBD, with a maximum THC content of 0.3% in the following circumstances:

  • You comply with all applicable local, state, and federal laws regarding the production, processing, distribution, and sale of hemp.
  • You retain a record that establishes your compliance with the laws. This record includes lab test reports or compliance reports for at least two years after the mailing date.

You don’t need to present the documentation when you mail the CBD. However, the agency can request it at that time or any date in the future.

This update comes several months after the USPS was embroiled in a legal battle for improperly seizing hemp-derived CBD. The case in question was KAB, LLC v. United States Postal Service. In September 2018, the administrative judge found that

“Congress currently permits the interstate sale, transportation, and distribution of exempt industrial hemp pursuant to the most recent appropriations act; I find that exempt industrial hemp and products derived from exempt industrial hemp are mailable.”

The USPS update acknowledges that the 2018 Farm Bill is law. The agency says once the Federal Government implements the code correctly, it will “modify the mailability criteria for CBD and cannabis products.” What the USPS is saying is that the Farm Bill’s regulatory framework is not yet established and provides “temporary” instructions. In essence, the USPS says it will loosen its guidelines when the Farm Bill becomes clearer.

When Mailing CBD Oil, Know That There’s a BIG Difference Between CBD and Other Cannabis Products

If the laws surrounding mailing CBD across state lines are murky at best, there is no such ambivalence when it comes to marijuana. Cannabis oils containing more than 0.3% THC are undeniably illegal. While there is a slight chance of a CBD package seizure, be sure that the authorities will take action for high-THC products.

Ultimately, you should be on safe ground if purchasing CBD derived from industrial hemp. If it is legal to grow the plant, there seems little reason why the cops would arrest any person using a substance derived from a legitimate crop.

Is It Legal to Mail CBD Oil?: Final Thoughts

The 2014 and 2018 Farm Acts seem to suggest that mailing lawful hemp and CBD is legal. It doesn’t matter whether they have the documentation specified by the USPS. On the plus side, the postal service is developing a method of ensuring that it seizes fewer packages. If nothing else, the guidelines are pragmatic.

Ultimately, the gap between federal and state law makes everything more confusing than necessary. We can’t say that you can definitely send bottles of hemp CBD oil across state lines to your friend. Equally, we wouldn’t know it is illegal either unless, of course, it contains more than 0.3% THC or is derived from cannabis.

The fact is, the authorities are not especially interested in confiscating your CBD package. This is why the industry is booming in the United States. If reputable brands such as PureKana knew it was illegal, do you think they would continue shipping products to all 50 states? At some point, their packages would get seized and ruin their businesses. Law enforcement would have to do the same thing with the hundreds of CBD companies operating in the United States.

For the most part, the authorities in most states exercise common sense. The time and expenses of enforcing such an absurd law are enormous, and most agencies are content to use their resources elsewhere. If you live in a state where CBD is technically illegal, you may need to exercise a degree of caution. Even so, you’ll find that most CBD sellers ship to Nebraska, Idaho, and South Dakota. Why? Because they are confident of avoiding legal consequences.

Crystalline Isolate is an extremely pure form of cannabinoid that is extracted using CO2 or butane/propane. Available in both THC-A and CBD, crystalline can contain up to 99.97% THC or CBD depending on the application.

For some this high-potency offering may seem excessive, but for many it is rather attractive. Medical marijuana patients are actively seeking the benefits of higher doses while veteran smoker may be looking for a new level of high. No matter the use, crystalline isolate is an exciting development within the chemistry of cannabis and the development of novel methods of consumption devoid of any harmful solvents and carcinogens.

While it is certainly possible to draw out extracts that are extremely high in THC and CBD with CO2 and hydrocarbon extraction and distillation, but THC-A and CBD crystalline opens up different potentials for storage and consumption to the market. For instance, storage is much more convenient when using crystalline isolate, less messy when dabbing, and easier to incorporate into foods and topicals (presuming you have decarboxylated your crystals). Did I mention that it is also very pretty to look at?

So How Do They Make This Stuff?

You may be familiar with extractions, and if you’re not feel free to check out this article here discussing the two main types to refresh your knowledge, either way, in order to form crystals you must start with a cannabinoid-rich cannabis extract.

Ideally, in order to maximize on time and resources, A-grade flower with a high THC-A or CBD count (depending on what you’re isolating) will be blasted with CO2 or butane/propane in order to extract the greatest yield of cannabinoids from the plant material. The crude oil that is extracted isn’t completely “clean” and will typically have a fair amount of waxes and lipids emulsified within the oil. Once the crude oil is winterized and the major waxes and lipids are filtered we would be left with cannabis extract that could be placed within a vape cartridge or dabbed on a rig. However, this oil will range from 65-90% THC or CBD and still exist within a viscous/fluid state. In order to solidify the cannabinoids out of the remaining non-cannabinoid material, we must take the cannabis extract add different solvents in different stages and run it through a number of different filtrations.

The first step is to take your cannabis extract and mix it with acetic acid and hexane, the combination of chemicals will act as a solvent to separate the dissolved plant matter from the THC/CBD. After the mixture has had time to settle, it is put through a filter and then the remaining fluid is placed within a roto-vape where the acetic acid and hexane are evaporated off. The remaining mixture will be primarily Delta-9 THC-A or CBD-A.

In order to further purify the extract, chromatography is used in order to separate impure elements of the solution from the desired cannabinoids. Chromatography (sounds complicated but isn’t really) is a chemical process where different materials and mediums are used to separate different components within a solution based on its affinity to the different filter mediums and density (kind’ve like your standard water filter). In the instance of THC-A, chemists add Sephadex-LH20, dichloromethane and chloroform in order to further clarify the cannabis extract into majority cannabinoids and solvent devoid of any plant material.

The remaining solvent from the mixture needs to be evaporated, so it is placed within the roto-vape again, where it crystallizes. Afterwards, in order to make the crystals consumable, they go through a series of chemical washes, filtrations and roto-vaping.

Post chromatography, the crystals are dissolved in methanol and then filtered and then roto-vaped to remove the methanol. Afterward, pentane is used to remove the smallest bits of non-THC or non-CBD material and then roto-vaped for the last time. The results, white crystals testing at 99.97% cannabinoid.

The only caveat to this is that you will not have the accompanying terpenes, and therefore will not experience the “entourage effect” that cannabis flower provides. However if you are intent on re-creating such an experience, you can reintroduce cannabis terpenes into your crystalline, or simply soak it within “terp sauce”.

You’re far less likely to run into authorities if you extract your CBD from pure hemp instead of marijuana, but cannabis can be confusing to people who have no experience with it. Hemp and marijuana are both from the cannabis plant, but they’re used for very different purposes. CBD oil has enough legal implications that there hasn’t been a lot of official research on it. Can You Treat Coughs and Colds with Cannabis?

During winter, coughs and colds are something most of us deal with. Although the simple, ubiquitous viruses that cause these common illnesses are hard to “cure” outright, there are various ways that cannabis can be used to ease their symptoms. We will discuss how to incorporate cannabis into your diet and health care regime to prevent and treat colds.

The common cold is a viral, highly contagious illness that is more likely to affect people during the winter months. Responsible for a range of symptoms including dry or chesty cough, runny or congested nose, sore throat, fever and fatigue, the common cold is not caused by just one virus. Instead, it is associated with as many as 200 different viruses.

One type of virus particularly associated with the common cold is the rhinovirus (with “rhino” meaning “nose”, this literally just means “nose-virus”!), which can be the culprit for up to 40% of colds There are three main species of rhinovirus and at least 99 different serotypes (strains). As well as rhinovirus, the common cold is also associated with various strains of coronavirus, adenovirus, enterovirus and influenza virus.

How do cold viruses cause symptoms?

Cold viruses are passed from person to person by hand-to-hand and hand-to-surface contact, as well as airborne transmission of viral particles. Hence, it is important to cover the mouth or nose while coughing or sneezing, and to wash hands regularly!

Once a cold virus has infected a human host, it gets to work – infiltrating the mucous membranes of the nose, mouth, throat and reproducing rapidly. For the most part, cold viruses such as rhinovirus don’t cause any particular damage to the body – they simply cause an immune response as the body recognises unwanted invaders exploiting its resources.

But for immunocompromised people or individuals suffering from asthma or COPD, catching a cold can be seriously bad news.

Many rhinovirus serotypes bind to an immune protein known as intercellular adhesion molecule 1 (ICAM-1). This protein is present on the outer cell membrane of certain epithelial cells (which make up the upper layer of the mucous membranes). The rhinovirus essentially hijacks it to gain entry to the interior of the cell. Once the virus has gained entry to its first host cell, it can take control of the cell and hijack its reproductive system in order to reproduce itself. (Yikes!)

Usually, ICAM-1 helps cells adhere (stick together), particularly after injury or stress. But when it gets hijacked by the rhinovirus, it sparks off a release of pro-inflammatory cytokines (cell signalling proteins), which leads to inflammation of the mucous membranes of the throat and nose.

This inflammatory response is key to the congested and sore feeling associated with having a cold. For most people, that’s pretty much the worst of it – but it can lead to severe complications, including pneumonia, for certain people.

Cannabinoids and ICAM-1

The endocannabinoid system is now well-known to be deeply involved with the immune system and cannabinoids have been repeatedly demonstrated to cause complex immunological effects. But when it comes to ICAM-1, there is sparse research available, and apparently nothing on the direct relationship between cannabinoids, ICAM-1 and rhinovirus.

There is evidence that cannabinoids can influence ICAM-1 expression levels in certain situations, though. One study reveals that CBD and THC can both cause increased expression of ICAM-1 on certain lung cancer cells, which leads to an increased rate of cell “lysis” (cell death via disintegration of the membrane).

This may be good news for cancer research, but increased expression of ICAM-1 is certainly not what one needs when trying to prevent a rhinovirus from taking hold. In fact, there is evidence that rhinovirus can increase the expression of ICAM-1 in order to provide itself more hijacking opportunities! Perhaps more useful is the discovery that certain cannabinoids can reduce the expression of ICAM-1 in other situations.

For example, the synthetic cannabinoid R(+)WIN 55,212-2 may indirectly block the expression of ICAM-1 by blocking the activity of interleukin-1, another important immunological protein. This particular study investigated multiple sclerosis and how cannabinoids can help slow its progression – and intriguingly, there is a growing body of evidence suggesting that rhinovirus could be instrumental in the pathogenesis (development) of MS.

Clearly, there is still much to learn about the transmission and pathology of the rhinovirus and other types of common cold virus – as well as how all this relates to chronic autoimmune disorders like MS. But it’s clear that the endocannabinoid system is fundamentally involved. There may be potential for certain cannabinoids to help prevent the transmission of rhinoviruses in certain situations by reducing the expression of ICAM-1.

So how can cannabinoids help treat coughs and colds?

Despite all our best efforts, and no matter how healthy we are, it is almost inevitable that sooner or later one of those 200 viruses is going to overcome our body’s defence systems and cause a cold or cough. When that happens, there’s not a whole lot that can be done to actually cure the illness – cold viruses are so numerous and so quick to mutate that developing effective antivirals and vaccines is all but impossible.

So when we catch a cold, it is pretty much inevitable that we will have to let the virus run its course and that we will feel significantly subpar for several days. But there are various ways we can ease the symptoms of colds and coughs. For example:

  • honey
  • salt-water gargles
  • saline drips
  • ibuprofen
  • paracetamol

Of course, you probably already know that… But what about cannabis? There’s plenty of evidence that various compounds in cannabis have anti-inflammatory and analgesic effects. THC, CBD, CBC and CBG are all known to exert. There are also plenty of terpenes and terpenoids in cannabis with similar properties, such as linalool, limonene and eucalyptol.

Various cannabinoids and terpenoids are even known for their relaxing, anti-anxiety or sedative effects. During times of illness, such properties may be very useful in increasing subjective feelings of wellbeing. And as what some might consider a bonus? Common colds can also cause appetite loss in some people and THC in particular has been repeatedly demonstrated to have appetite-stimulating properties.

How to use cannabis during a cold

When we catch a cold, we are likely to experience nasal congestion and sinus pain, sore throat, dry or chesty cough and irritated watery eyes – None of these symptoms are improved by smoking of any substance. Even vaping or dabbing will probably exacerbate sore throats and coughs – even if these methods are usually not as hot or as harsh as smoking itself.

For this reason, it’s best to stick to edibles, topicals and anything else that doesn’t cause irritation to the throat and lungs. Hard candies infused with CBD or THC can help soothe throat inflammation and soreness. At least one US company, Jolly Meds, offers THC-CBD lozenges with added menthol and eucalyptus oils to enhance their soothing and decongestant effects.

Another method that many people report to provide subjective relief is cannabis tea. Teas and herbal infusions can offer soothing, warming and comforting relief from cold and cough symptoms. When cannabis extracts are added, they may provide extra help in the fight against inflammation and pain.

There are many ways to make cannabis tea. The general idea though, is to ensure that at least some fat or oil is used. This will allow the cannabinoids to dissolve and infuse through the mixture. Hot water alone will not dissolve cannabinoids. Therefore, making some cannabutter or cannabis-infused milk and adding that to a hot-water infusion may yield improved results.

As well as cannabinoids themselves, various other plant compounds could provide benefits if infused into tea. For example, tea (particularly green tea) contains catechin flavonoids, which have been found to be beneficial against cold and flu viruses.

With winter comes the dreaded coughs and colds we all hate. While it’s hard to outright “cure” them, there are several ways cannabis can help.
